Privacy Policy for SF Mobile-Vision, Inc.’s BWX Mobile App

1. Introduction

This is the privacy policy (this “Policy”) for the BWX-100 Mobile application (the “App”) provided by SF Mobile-Vision, Inc. (“Company” or “we,” “us” and “our”). The App is intended for use solely by individuals (each, an “Authorized User”) who both (i) are employees of law enforcement organizations located within the United States of America and (ii) are authorized to use the body-worn camera units (each, a “BWC Unit”) developed and sold by us to such organizations (“our Customers”). Use of the App by any person other than an Authorized User is prohibited. By accessing or using the App, you represent that you are an Authorized User.

We respect your privacy and are committed to protecting it through our compliance with this Policy. This Policy describes the types of information we may collect from you, or that you may provide, in connection with your use of the App (the “Information”). Please read this Policy carefully to understand our policies and practices regarding such Information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the App. By accessing or using the App, you agree to this Policy and consent to our collection, use and sharing of your Information as described herein. This Policy may change from time to time (see Section 6 below). Your continued use of this App after we
make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

2. Information Which May Be Collected and How It May Be Used

Your use of the App’s functional features requires communication, in the form of Bluetooth sharing, between the device on which you have downloaded the App (the “App Device”) and the BWC Unit assigned for your use by our applicable Customer. This communication also may include use of the Reminder function on your App Device, to prompt you to connect the App Device to the BWC Unit via WiFi. As a result, we will or may have access to your user ID (which may be your actual name), badge number, or other information which may be associated with you personally, which have been provided previously in connection with such assignment to you of such BWC Unit, in order to allow you to use the App in conjunction with such BWC Unit. In addition, if you contact our technical support service for assistance with your use of the App, we will have access to such information about you which you provide to facilitate our providing you with such assistance.

3. Parties With Whom We May Share Information

We may share Information (i) with third-party suppliers or contractors as reasonably necessary for the provision of our services, (ii) with a limited number of other third parties as reasonably necessary forcompliance with applicable laws, rules, regulations, court orders or other legal process (collectively, “Legal Requirements”), or in the defense of legal claims, and/or (iii) with a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution with respect to Company, or other sale or transfer of some or all of Company’s capital stock or assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.

4. Confirming and/or Correcting Your Information

You may send us an email at dessupport.mvi@safefleet.net to request confirmation of what Information about you we have in our possession, and/or to correct or delete any of same, except that (i) we cannot delete such Information without also terminating your access to the App and the applicable BWC Unit(s) and (ii) we may not accommodate a request to change Information if we believe such change would violate any Legal Requirements or cause such Information to be incorrect.

5. Information Security

We use a variety of technical, physical, and administrative security measures to secure the confidentiality of Information and to protect it from loss, misuse, alteration, and destruction. However, due to the design of the Internet and other online and wireless technology systems and other factors outside our control, we cannot guarantee that communications between you and our servers will be free from unauthorized access by third parties or by government agencies. You remain responsible for protecting your user name and passwords and for the security of information in transit to us over these systems.

6. Changes to this Policy

It is our policy to post any changes we make to our privacy policy on this page. If any such changes are material changes, we may also contact our users via our Customers with the new details. The date this Policy was last revised is identified at the top of the page. We encourage you to review this Policy from time to time to stay informed about its contents. Your continued use of the App covered by this Policy constitutes your consent to the practices in place at the time of your use.
